LAST WILL AND TESTAMENT OF BENEVILL YARGER - DEC'D
I, Benevill Yarger, resident of the town of Wanatah, LaPorte County Indiana being of sound and disposing mind and memory do make publish and declare this as and for the last will and testament in manner and form following.
     Item 1st - It is my will and I direct that all my just debts funeral expenses, and expense of last sickeness be first paid out of my estate as soon as can reasonably be done, and for that purpose I devise and bequeath to my executor hereinafter named Lot No three (3) Block No Twelve (12) in the town of Wanatah, Indiana, with full power and authority in my said Executor to sell and convey the same for such price as he may deem best, without appraisement or notice and without any proceedings in or order of Court whatever, and from the proceeds thereof he shall first pay said debts and expenses in the order of their priority and shall then dispose of the remainder thereof as hereinafter directed.

     Item 2nd - I give devise and bequeath to my wife_____________Yarger should she survive me, to be had and held by her in lieu of any and all interest she would otherwise and by law be entitled to have and receive from my estate including the five hundred dollars allowed by the statute, the following property to wit. Lot No. Seven (7) Block it in Doud & Williams Addition to Wanatah, Indiana, she shall also have all carpets and bedding that she brought with her when we were married. Also the lounge and bureau and the carpet in the dining room, and the one half of all extra bed comfortors and I request that she move into the house on the said lot herein devised to her within six months after my decease as that will afford her a comfortable home and the property in which I designed for her living and from the time she shall so move so long as she shall remain in the town of Wanatah she shall have and receive for her support all rent or rents, received from or earned by the property in which we now live, which I have given to my son Perry but which rents she shall receive only on condition that she shall first release to my said son by proper quit claim deed any and all interest on claim in and to said property given to him and in which we now reside.
     Item 3 - I have given and conveyed by deed to my son W. Perry Yarger the property on which we now live vis. Lot One (1) Block "B" Martins. Addition to the town of Wanatah, Indiana, to be had held and owned by him in fee simple?, subject to my life estate and subject to the payment by him to my said wife, the rent if used by others and the reasonable rental thereof if occupied by himself from the time my said wife shall move there from so long as she remains and lives in the town of Wanatha provided she shall first release to him by proper quit claim deed all interest in said lot as above provided, except however her said right to receive the said rent as specified. I also give devise and bequeath to my said son W.P. Yarger the carpet in the front room, our bed and bedding complete and one half of all extra bed comforters, Providing always that the said property so given and bequeathed to my said son Perry is so given to him subject to the payment of the sum of twenty-five dollars to each of my other children viz: Israel, George, Fred, John, Mary Zern, Ella Freeman, Chesty Gross, Adaline M. Osborn, and Elnor Yarger. which said payment shall be a lien on said property until paid or released.
     Item 4th - I hereby nominate and appoint my son W.P. Yarger, Executor of this my last will and testament will full power and authority in him to do any and all things whatsoever for the purpose of settling my estate including the sale and conveyance of the real estate herein before? mentioned and of any personal property of which I may die? seized not here in specifically bequeathed, all without any order of Court therefore and without taking out Letters Hereon or any proceedings in Court except the probate and record of this will. After the sale of said property and the payment of all debts and expenses, including the expenses of the probating this will sale of said property and settlement of my estate, the surplus money if any remain shall be paid to my said wife when she shall have released to said Perry her interest in said property given to him, and should she refuse to so release this? said surplus shall be retained by him.
    Item 5th - I hereby revoke set aside and cancel and hold as for nauaght? any and all other or former will or wills by me at any time heretofore made. In testimony whereof I have hereunto set my hand and seal this 16 day of Dec 1889.

Benevill Yarger (Seal) - The above and foregoing instrument in writing was on the day of it's date, signed, sealed and declared by the said Benevill Yarger in our presence as and for his last will and testament and was signed by us in his presence and in the presence of each other at his request as witnesses thereto. State of Indiana, LaPorte County, In: Be it Remembered That on the 21 day of July 1890 Otto Groth one of the subscribing witnesses to the within and foregoing Last Will and Testament of Benevill Yarger late of said County, deceased, personally appeared before the Clerk of the Circuit Court of LaPorte County, in the State of Indiana, and being duly sworn by the Clerk of said Court upon his oath declared and testified, as follows, that is to say: That on the 16th day of December 1889 he saw the said Benevill Yarger sign his name to said instrument in writing as and for his last Will and Testament, and that the deponent at the same time heard the said Benevill Yarger declare the said instrument in writing to be his last Will and Testament, and that the said instrument in writing was at the same time, at the request of the said Benevill Yarger and with his consent attested and subscribed by the said
  Oto Groth and Jason Osborn in the presence of each other as subscribing witnesses thereto, and that the said Benevill Yarger was at the time of the signing and subscribing of the said instrument in writing as aforesaid, of full age, (that is more than Twenty-one years of age) and of sound and disposing mind and memory and not under any coercion or restraint and as the said deponent verily believes: and further deponent says not.
  Otto Groth Sworn to and subscribed by the said witness before me Herman W. Tallwasser Clerk of said Court at LaPorte, the 21 day of July 1890. In attestation whereof, I have hereunto subscribed my name and affixed the seal of said Court. (Seal) H.W. Tallwasser, Clerk State of Indiana, LaPorte County, SS: I Herman W. Tallwasser clerk of the Circuit Court of LaPorte County Indiana, do hereby certify that the within annexed Will and Testament of Benevill Yarger has been duly admitted to probate and duly proved by the testimony of Otto Groth one of the subscribing witnesses thereto, that a complete record of said will and of the testimony of the said Otto Groth in proof thereof has been by me duly made and recorded in book "D" at pages 1256-7-8-&9 of the Record of Wills of said county.
